FIFA Warns Football Kenya Federation Of Sanctions Over AGM Delay
The Football Kenya Federation (FKF) has been issued a serious warning by the world governing body FIFA regarding the delay in their Annual General Meeting (AGM) & the subsequent elections scheduled for later this year.
The situation arose when a sports journalist, Milton Nyakundi, obtained a court order halting the AGM, stating concerns over the legality of the federation convening the meeting.
FIFA’s Chief Member of Associates, Kenny Jean-Marie, expressed FIFA’s concerns in a letter addressed to the FKF, highlighting the potential consequences of further delays.
The letter stated, “We further wish to underline that a violation of this obligation by the FKF or its members may lead to sanctions as provided for in the FIFA Statutes, including a possible suspension.”
The letter also raised issues regarding potential third-party influence on the federation’s affairs, stating, “…the order of the Mombasa High Court…appears to amount to undue influence by third parties which could be considered as a violation of Article 19 paragraph 1 of the FIFA Statutes & Article 7 paragraph 1.g. of the CAF Statutes.”
FIFA emphasized the importance of upholding the principles outlined in its statutes and warned against any attempts to obstruct the AGM.
Furthermore, FIFA highlighted the potential repercussions of non-compliance, stating, “The infringement of the aforementioned provisions of the FIFA and CAF Statutes may give rise to grounds for the suspension of FKF irrespective of whether the infringement was attributed to FKF or not.”
The letter made it clear that a suspended member association would lose its membership rights, including the ability to engage in sporting activities with other member associations.
FIFA directed the FKF to expedite the AGM & ensure that the elections proceed as scheduled. The letter concluded with a reminder of the consequences of failing to adhere to FIFA’s directives, emphasizing the importance of conducting the AGM and elections promptly.
This development comes in the wake of FIFA lifting a previous ban imposed on Kenya due to government interference.
The AGM was set to address key issues such as the FKF Electoral Code and the FKF Elections Board. Several prominent figures, including former FKF President Sam Nyamweya, Extreme Sports CEO Mohammed Hussein, and others, have expressed their interest in vying for the top position within the FKF.
